في العدد السابق من “بخصوص”، نشرنا الجزء الأول من هذا المقال الذي يتحدث عن المواد القانونية المجحفة في الدستور اللبناني بحق المواطنين والمواطنات وحرياتهم/ن الشخصية بشكل عام مهما اختلفت ميولهم الجنسية وطوائفهم (لقراءة الجزء الأول ). وفي هذا العدد، ننشر الجزء الثاني:
ولكن المادة 534 ليست المادة الوحيدة التي تمس بحريات مثلييّ/ات الجنس والمواطنين/ات اللبنانيين/ات بشكل عام، لكنها المحرك الأكبر والدافع الذي من خلاله يطال القانون حريات المواطن/ة اللبناني/ة لاسيما مثليي/ات الجنس ، حتى الحريات الأكثر طبيعية والأكثر بديهيّة منها.

لبنان بلد الحريات والمجتمع المثال لكل المجتمعات العربية بانفتاحه وتعايش ابنائه وتفهمه لحاجات شبابه وبتقديم كل أساليب التطور والتقدم لهم: بروباغندا تعايشنا معها كشباب وشابات لبنانيين وتربينا على وقعها الرنان الذي يطرب أذن كل شخص يبحث عن مجتمع يوتوبي. ولكن ما لا يعرفه العالم هو أن قصة الحريات في لبنان هي قصة معركة مستمرة وصراع لا ينتهي لمواجهة القانون من جهة، والمجتمع والعقلية المتخلفة من جهة أخرى.
فشباب لبنان اليوم تائهون بين قوانين تدعي إحترام الحرية الشخصية وتتباهى بتطبيق المواثيق العالمية لحقوق الانسان، وقوانين تجرم تطبيق حريات معينة ولا تمت بأية صلة لإحترام حقوق الإنسان.

Helem’s latest publication, Only 534, offers a concise and informative analysis of article 534 of the Lebanese penal code, which criminalizes “unnatural sexual intercourse”. Following Nizar Saghieh’s excellent legal analysis of the application of article 534 published by Helem earlier this year (link), this booklet aims to distill some of the most relevant ideas in a manner that is clear, accessible, and useful for LGBTs in Lebanon. It is also unique in pushing forward very explicit rights-based language for issues of sexual orientation (and to a lesser degree) gender identity.

Lebanon-based LGBT organization Helem launched on Monday, February 8, 2010 in Beirut a report on institutional discrimination against LGBTs in Lebanon, consisting of two studies. Funded by the Ford Foundation, the report concluded a series of thematic researches that address the effect of Article 534 on the political, civil, economical, social, and cultural rights of people of non-conforming gender identities and sexual orientations.

من الواضح ان المادة 534 من قانون العقوبات اللبناني لا تسمح فقط للشرطة بأن تعتقل المثليين والمثليات، بل هي تشكل دافعا ودعما لكل من يضمر الكره للمثليين. فهذه المادة لا تستعمل لـ”عقاب المثليين” بل تستعمل ايضا لابتزازهم مالياً والتعرض لهم من دون ان يستطيعوا ان يحتموا بالقانون. وكأن المادة في معانيها المتعددة تدفع بالمثليين الى [...]
